Outside the SCOPE of the EU AI Act*

The EU AI Act does not apply to the following entities and activities, as specified in Article 2 sections 3 to 12:

• Private, non-professional use of AI Systems by individuals.

• Military, defence, and national security applications, which are explicitly excluded.

• AI Systems or AI Models used exclusively for scientific research and development, including those not yet placed on the market or put into service.
• Open-source AI systems released under free licences, unless they qualify as high-risk or fall under prohibited practices.

• Public authorities in third countries and international organizations whose use of AI systems is subject to international agreements for law enforcement and judicial cooperation.

These exemptions ensure that the EU AI Act focuses on commercial and high-risk AI Systems, while safeguarding space for research and innovation.
